The Build America, Buy America Act (BABA) was enacted as part of the Infrastructure Investment and Jobs Act (IIJA) on November 15, 2021. It establishes a “Buy America Preference” for federally funded infrastructure projects, requiring that iron, steel, manufactured products, and construction materials be produced in the United States.

While the Act itself was passed by Congress and signed into law by President Joseph Biden, federal agencies—such as the U.S. Department of Housing and Urban Development (HUD)—are responsible for implementing the Act within their own programs and issuing project-specific guidelines or waivers.
